This Warranty Agreement (“Agreement”) is made effective as of August 10, 2026, by and between Brainwave Computers AKA MakerForce Technology Inc., with a principal place of business at 833 SE Main St., Oregon 97214 (“Manufacturer”), and __________, residing at __________, __________ __________ (“Customer”).

Limitation of Damages
In no event shall Brainwave Computers AKA MakerForce Technology Inc. be liable for consequential damages for breach of this warranty. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to the buyer.
Warranty Coverage
Brainwave Computers AKA MakerForce Technology Inc. warrants the Covered Product to be free of all defects in material and workmanship for 2 years for Brainwave branded laptops and Desktops year(s) from August 10, 2026. This warranty extends to the original buyer (only) and each successive buyer within the warranty period.
Scope of Warranty
This warranty covers:
- Manufacturing defects
- Defective components
- Malfunction under normal usage conditions
This warranty does not cover:
- Damage due to misuse, abuse, accident, or neglect
- Unauthorized modifications or repairs
- Normal wear and tear
Customer Obligations
To obtain warranty service, the Customer must notify the Manufacturer of the defect within the warranty period, provide proof of purchase, and return the Covered Product for inspection if required.
Remedies
If a covered defect is found, the Manufacturer will, at its sole discretion:
- Repair the Product using new or refurbished parts;
- Replace the Product with an equivalent model;
- Refund the purchase price
Limitation of Liability
Under no circumstance shall either party be liable to the other party or any third party for indirect, incidental, consequential, special or exemplary damages (even if that party has been advised of the possibility of such damages), arising from any provision of this agreement such as, but not limited to, loss of revenue or anticipated profit or lost business, cost of delay or failure of delivery, or liabilities to third parties arising from any source.
Exclusions
This warranty is void if the Covered Product has been:
- Altered or repaired by an unauthorized person;
- Used for purposes other than its intended use;
- Damaged due to environmental conditions not recommended by the Manufacturer
Governing Law
This Agreement shall be governed by the laws of Oregon.
Entire Agreement
This Agreement contains the entire agreement of the parties with respect to the subject matter contained herein. No other promises, warranties, representations, agreements, or understandings, whether oral or written, exist concerning this subject matter. This Agreement supersedes any previous or simultaneous oral or written promises, warranties, representations, agreements, or conditions between the parties.
Severability
If any provision of this Agreement shall be held to be invalid, illegal, or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid, illegal, or unenforceable, but that by limiting such provision, it will become valid, legal, and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
Alternative Dispute Resolution
The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations among the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (“ADR”) procedure.
If any controversies, claims, or disputes arising out of or relating to this Agreement cannot be resolved through negotiation, the parties agree to try in good faith to settle the dispute by mediation in accordance with any statutory rules of mediation. If mediation is unavailable or unsuccessful in resolving the entire dispute, any outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association.
The parties shall select a mutually acceptable arbitrator knowledgeable about issues relating to the subject matter of this Agreement. The arbitrator’s award will be final, and any court with proper jurisdiction may enter judgment upon it. During the continuance of any arbitration proceeding, the parties shall continue to perform their respective obligations under this Agreement.
How to Obtain Warranty Service
If warranty repairs are to be made at an authorized service center:
The buyer should carefully pack the Covered Product, preferably in the original packing materials, and deliver it, together with a copy of the original purchase receipt and a description of the problem, to one of the following repair and service facilities:

If the buyer sends the product by U.S. mail, we recommend that the buyer insure it and send it return receipt requested. We accept no liability for products lost or misplaced in shipment.
If Brainwave Computers AKA MakerForce Technology Inc. does not maintain service facilities for express warranty repairs in a state, and warranty repairs will not be made in the home:
Upon discovery of any defect, malfunction, or nonconformity in the Covered Product, the buyer may choose one of the following options for obtaining warranty service and repairs:
(a) The buyer should carefully pack the Covered Product, preferably in the original packing materials, and deliver it, together with a copy of the original purchase receipt and a description of the problem, to:

(b) The buyer may return the Covered Product to the retail seller, or to any retail seller of like goods of the same manufacturer, who will do one of the following:
If the buyer sends the product by U.S. mail, we recommend that the buyer insure it and send it return receipt requested. We accept no liability for products lost or misplaced in shipment.
- Service or repair the Covered Product to conform to the applicable warranty.
- Direct the buyer to a reasonably close independent repair or service facility.
- Replace the Covered Product with goods that are identical or reasonably equivalent to the warranted goods.
- Refund to the buyer the original purchase price, less that amount directly attributable to use by the buyer prior to the discovery of the nonconformity.
(c) The buyer may secure the services of an independent repair or service facility for the service or repair of the Covered Product, when service or repair of the goods can be economically accomplished and when the buyer is not furnished appropriate relief under the provisions of subparagraph (b). In that event, Brainwave Computers AKA MakerForce Technology Inc. will reimburse the independent repair or service facility for the reasonable cost of service and repair, including any cost for parts and any reasonable cost of transporting the goods or parts, plus a reasonable profit.
Registration Card
We recommend that the buyer fill out and send in the registration card included in the original package of the Covered Product. This will facilitate any warranty repairs or service, if needed. It is not required that the buyer send in this registration card for this warranty to be effective.
Notice to Buyer
This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. You have the right to bring any action at law or equity to resolve disputes concerning or to enforce the provisions of this warranty.
